$18.4 Million Settlement to Protect Consumers Against Publishers Clearing
House Sweepstakes!
PCH has agreed top pay more than 18 million dollars to 23 states,
plus the District of Columbia to settle allegations that it used deceptive
sweepstakes promotions to get consumers to purchase publications.
Sweepstakes mailings that go out in late December this year by PCH
will include text stating facts about sweepstakes and a reminder letter
telling consumers that no purchase is necessary to participate in
sweepstakes. They will also stop using personalized, simulated checks
to represent prizes unless they are clearly marked that they are not
actual checks. This settlement also prohibits PCH from using "You
are a Winner" statement unless it provides in equal prominence the
important qualifying conditions necessary for winning.
Most importantly, this settlement requires a "Sweepstakes Facts Box"
be included on all sweeps that will disclose the odds of winning,
together with all the prizes, values, quantities and the end date
for the sweeps. The box, which is similar to the Food and Drug Administration's
nutrition label, must also include disclaimers informing consumers
that "buying won't help you win" and "you have not yet won".
PCH claims that its mailings were clear and said it has awarded close
to $160 million in prizes during the last 46 years. The company, based
in Port Washington, NY, also said it made this settlement to avoid
further litigation costs in so many states. They are working with
remaining states to reach a nationwide settlement.
"Hopefully, the settlement we've reached today will bring an end to
a practice that has left too many citizens nearly penniless and their
families devastated", says Washington State Attorney General Christine
Gregoire.
